TERMS OF SERVICE

1. AGREEMENT TO THESE TERMS

These Terms of Service (“Terms”) govern your access to and use of the Belka mobile application (“Belka” or the “App”) and any related services we provide with it (collectively, the “Services”).

The Services are provided by Free Russians e.V. (“Association,” “we,” “us,” or “our”), an association registered with Amtsgericht München under VR 209634.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. WHO WE ARE AND WHAT BELKA IS

Belka is a mobile application designed to support polls and voting in private groups and similar organized participation workflows.

Use of Belka may be limited to users who are invited, registered, or otherwise determined to be eligible for a particular poll, vote, or event. Access to the App does not automatically entitle a user to participate in any specific vote or poll.

We may modify, limit, or discontinue parts of the Services at any time.

3. ELIGIBILITY

You may use the Services only if you have the legal capacity to enter into a binding agreement and are at least 18 years old.

You may use the Services only in compliance with applicable law and these Terms.

4. ACCOUNT ACCESS AND SECURITY

You may need an account or other access credentials to use some parts of the Services.

You are responsible for:

  • providing accurate information where required;
  • keeping your authentication credentials confidential;
  • maintaining the security of your device;
  • all activity that occurs through your account or credentials, unless caused by our own fault.

If you believe your account, credentials, or device have been compromised, you must contact us promptly.

5. ACCEPTABLE USE

You may use the Services only for their intended purpose.

You must not:

  • use the Services in violation of applicable law;
  • access or attempt to access polls, votes, or data for which you are not authorized;
  • impersonate another person or misrepresent your eligibility or identity;
  • interfere with the integrity, secrecy, verification, tallying, or operation of any poll or vote;
  • attempt to duplicate, forge, manipulate, or submit fraudulent ballots, credentials, receipts, tokens, or verification artifacts;
  • circumvent or interfere with security features, authentication measures, or access controls;
  • reverse engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by mandatory law;
  • use bots, scripts, scraping tools, or other automated means to access or interact with the Services without our prior written permission;
  • introduce malware, harmful code, or abusive traffic;
  • use the Services for commercial exploitation unless we have expressly approved it in writing.

We may suspend, restrict, or terminate access where we reasonably believe these Terms have been violated or the integrity or security of the Services is at risk.

6. INTELLECTUAL PROPERTY

The Services, including the App, software, design, text, graphics, logos, and other materials we provide through the Services, are owned by us or licensed to us and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App and access the Services for your personal, non-commercial use for their intended purpose.

Except as expressly permitted in these Terms or by mandatory law, you may not copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, transmit, or otherwise exploit any part of the Services.

7. FEEDBACK

If you send us suggestions, ideas, or feedback about the Services, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback to operate, improve, and develop the Services. This does not transfer ownership of your personal data and does not override our Privacy Policy.

8. PRIVACY

Our Privacy Policy explains how we process personal data in connection with the Services and is incorporated into these Terms by reference.

9. AVAILABILITY, CHANGES, AND UPDATES

We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.

We may update, change, suspend, or discontinue all or part of the Services at any time, including to maintain security, improve functionality, comply with law, or reflect organizational changes.

We may also update these Terms from time to time. If we do, we will update the “Last updated” date. Your continued use of the Services after updated Terms become effective means you accept the revised Terms.

10. TERMINATION

These Terms apply for as long as you use the Services.

We may suspend or terminate your access immediately if:

  • you materially breach these Terms;
  • we reasonably believe your use creates security, legal, or operational risk;
  • continued access could compromise the integrity of a poll, vote, or the Services.

You may stop using the Services at any time.

Sections that by their nature should survive termination, including intellectual property, liability, governing law, and dispute provisions, will survive.

11. DISCLAIMERS

The Services are provided on an “as is” and “as available” basis.

To the extent permitted by law, we do not guarantee that:

  • the Services will always be available or uninterrupted;
  • any poll or vote will always be accessible at a particular time;
  • any transmission, submission, or device-side action will succeed unless confirmed by the Services;
  • the Services will be free from defects, delays, or security incidents.

Nothing in these Terms excludes any rights you may have under mandatory law.

12. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

We are fully liable for intent, gross negligence, injury to life, body, or health, and in all other cases where liability is mandatory by law.

In cases of ordinary negligence, we are liable only for breach of an essential contractual obligation, and in that case only for foreseeable damage typical for the contract.

13. GOVERNING LAW AND VENUE

These Terms are governed by the laws of Germany, excluding conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer resident in the European Union, you also retain the protection of mandatory provisions of the law of your country of residence.

If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction shall be Munich, Germany, unless mandatory law provides otherwise.

14. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional rules or notices expressly made part of the Services, constitute the entire agreement between you and us regarding the Services.
